Terms and conditions for Digital Monday's services
Terms and conditions
1. Definitions
1.1 "You" means the business or person who signs up. "We", "us" and "Digital Monday" mean Digital Monday (digitalmonday.com), an Australian-owned business run by Steven Morey.
1.2 "Services" means the SEO, AEO (answer engine optimisation), web content, web design, hosting and website upkeep we provide to you under these terms.
1.3 "Website" means the business website we look after for you. "Content" means the text, images, logos, data and other material on it, or that you give us.
1.4 "Launch offer" means the free-months offer described in section 6. "Review copy" means the private preview of your website that we build before it goes live, which you check and approve using our review tools.
1.5 These terms apply when you sign up, use this website or use our services. If you do not agree to them, please do not sign up.
2. Who we work with
2.1 Digital Monday is built for brochure websites: sites that tell people what you do and get them to call or enquire, on platforms such as WordPress, Wix, Squarespace, Webflow or HubSpot.
2.2 We do not do online stores, product catalogues, member logins or custom web apps.
2.3 If your site turns out not to be a fit, we will tell you straight away, and we may decline to take it on.
2.4 If you have prepaid for a period in which we will not be doing the work, we refund the unused prepaid fees.
3. Getting started
3.1 The free uplift. When you sign up we check that your site is a fit. If it is, we copy your website onto our platform and modernise it. The uplift costs you nothing.
3.2 The queue. We bring sites across one at a time so each one is done properly. Your turn comes up in roughly 14 days. That is our expectation, not a promise of a date, and we will email you when we start on yours.
3.3 What we need from you. To do the work we need access to your website and its logins, access to your domain, and your approvals. We ask only for what the work needs.
3.4 Your old site and hosting. Your existing website stays where it is until the new one has been approved and goes live, and then your domain is pointed to the new site. Your old hosting stays yours: please keep it until we confirm the new site is live, and cancel it with its provider afterwards if you no longer need it.
4. Changes and approvals
4.1 How to ask. You ask for changes in the review tools we give you: pin a note to the part of the page you mean, or highlight some text, and say what you would like changed.
4.2 How approvals work. Nothing goes live without your approval, unless you choose auto-approve. You approve the work by pressing Approve in the review tools. A change you have asked for or approved is a change you have accepted.
4.3 Auto-approve. If you choose auto-approve, the changes you ask for go live without a separate approval step. You can switch it off again at any time.
4.4 Speed. We aim to make routine changes within 24 hours. That is an aim, not a guarantee.
4.5 Bigger jobs. A larger piece of work, such as a new page or the rebuild of a whole section, is handled as its own job. We tell you what it involves and roughly how long it will take before we start.
5. Fees and payment
5.1 Our price is $500 a month. The currency and any tax that applies are shown when you pay.
5.2 If a payment fails, work stops straight away: no payment, no work.
5.3 Your website hosting gets a 30-day grace period. Your website stays live for 30 days while you sort out the payment. After that, hosting may be suspended, as set out in section 16.
5.4 We give you 30 days' notice of any change to the fee, and the change takes effect only after that notice.
6. The launch offer
6.1 Our launch offer is 2 months free for the first 75 businesses, open until 1 November 2026 or until the 75 places are taken, whichever comes first.
6.2 The offer can end at any time, and we may close it early.
6.3 The launch offer does not change the guarantee. The guarantee is a separate promise, set out in section 7.
7. The guarantee
7.1 Results in 60 days, or your first two months back. No questions asked. Leave anytime, and keep your website.
7.2 You can claim the guarantee at any time within your first 60 days. If you claim, you get your first two months back and the service ends.
7.3 To make a claim, send us a message on the Contact us page.
8. Cancelling and leaving
8.1 You can cancel anytime with 30 days' notice. There's no lock-in contract, and you keep your website.
8.2 To give your notice, send us a message on the Contact us page.
8.3 During the notice period we keep your website live and keep looking after it as usual.
8.4 At the end we hand over your website, your content and your domain, and we help you move them to a new home if you ask.
8.5 After you leave, we keep your data for 180 days, then delete it.
9. Your responsibilities
9.1 Give us accurate information, and keep it up to date.
9.2 You confirm that you have the rights to the content, images and logos you give us, and the right to let us work on your website, domain and accounts.
9.3 Keep your accounts and logins secure, and tell us if you think someone else has got access to them.
9.4 Use the services lawfully. Please do not give us content that is unlawful, misleading or infringes anyone's rights.
10. Content and ownership
10.1 You own your content, your website and your domain.
10.2 We own our platform, engine, tools, templates and methods. We are not selling those to you.
10.3 You give us permission to copy, host, change and publish your content as needed to provide the services.
10.4 We show your website as an example of our work only if you say we can.
11. Hosting, security and backups
11.1 We host your website securely on our platform and look after it, including security updates and backups.
11.2 We work to keep your website available, but we cannot promise it will never be interrupted, because parts of the internet are outside our control.
11.3 We may carry out maintenance from time to time, and we keep any interruption as short as we can.
12. Third-party services
12.1 Our services connect to tools and platforms we do not own, such as search engines, AI tools, analytics tools, domain registrars and email providers.
12.2 They have their own terms, prices and changes, and we are not responsible for what they do or for changes they make.
12.3 If a third party charges for something you need, such as a domain renewal, that cost is yours, and we tell you before it applies.
13. Results disclaimer
13.1 Search engines and AI tools such as Google and ChatGPT decide what they show, not us.
13.2 Apart from the guarantee in section 7, we do not promise a particular ranking, number of visitors, number of enquiries or position in an AI answer.
14. Privacy and confidentiality
14.1 How we collect, use and protect your details is set out in our Privacy notice.
14.2 We keep the business information you share with us confidential, and we use it only to provide the services.
15. Liability
15.1 Our liability to you for anything arising from our services is limited to the fees you paid in the last 2 months, except where the law does not allow a limit.
15.2 Nothing in these terms limits your rights under the Australian Consumer Law.
15.3 Subject to that, we are not liable for indirect or consequential loss, such as lost profits or lost business.
16. Suspension and ending by us
16.1 We can pause or end our services if you do not pay, if you use the services in a way that is unlawful or harmful, or if we find your website is not one we can look after.
16.2 Before we do, we tell you why and give you a fair chance to put it right, except where the law or an urgent risk means we cannot wait.
16.3 Where it is fair, we refund any prepaid fees for a period we did not provide the services. You keep your website if we end the agreement.
17. Events outside our control
17.1 We are not responsible for a delay or failure caused by something outside our reasonable control, such as a power or internet outage, a problem at a hosting or platform provider, a change by a search engine, or a natural disaster.
17.2 If an event like that goes on for a long time, we tell you what it means for your services.
18. Changes to these terms
18.1 We may update these terms. We tell you by email, and a change that affects you takes effect only after we have told you.
18.2 The date at the bottom of this page shows when the terms last changed.
19. Disputes and governing law
19.1 If something goes wrong, please tell us first through the Contact us page, and we will work it out with you.
19.2 If we cannot sort it out together, we will try mediation before either of us goes to court.
19.3 These terms are governed by the law of Victoria, Australia, and you and we submit to the courts of Victoria.
20. General
20.1 These terms are the whole agreement between you and us about the services. They replace anything said or written earlier.
20.2 If a part of these terms cannot be enforced, the rest still applies.
20.3 You may not transfer your rights under these terms to someone else without our agreement. We may transfer ours to a business that takes over Digital Monday, and we will tell you if we do.
20.4 We send notices to the email address you gave us when you signed up. You send notices to us through the Contact us page.
21. Contact
21.1 To contact us about these terms or your services, use the Contact us page.
